Terms and Conditions for WinExpress

These Terms and Conditions govern your use of the WinExpress services. WinExpress (a fintech platform) operates in partnership with Providus Bank (our official banking sponsor). By accessing or using WinExpress (including the WinEx consumer app and WinEx School institutional app) you agree to be bound by these Terms. You must be at least 18 years old to use the general WinEx app. WinExpress accounts are opened in compliance with Nigerian regulations: all information provided during registration will be handled securely in accordance with the Nigeria Data Protection Regulation and shared with our partner bank (Providus Bank) for mandatory KYC and compliance purposes.

1. Eligibility and Account Registration

  • Age Requirement: To open a WinEx wallet account, you must be 18 years or older. Users under 18 are not permitted to register for the general app. (WinEx School accounts are for minors’ cards, but parents or guardians must sign up and maintain those accounts on behalf of their children.)

  • Registration Information: When creating an account, you agree to provide true, accurate and complete information and promptly update any changes. You are responsible for keeping your login credentials and PIN confidential, as we will not be liable for any loss due to compromised credentials.

  • Data Sharing: As part of regulatory compliance, we share required registration data with Providus Bank, our partner bank, for identity verification and fraud prevention. By registering, you consent to this information exchange. All personal data will be managed in line with Nigerian data protection laws.

2. Services Provided

WinExpress offers the following financial services to eligible users:

  • Digital Wallet: Store Naira funds in your WinEx wallet; check balances and transaction history in-app.

  • Physical Card: We issue a prepaid physical WinExpress card linked to your wallet, which can be used at POS terminals and ATMs (network fees may apply). (The WinEx School program issues similar cards for students, but those cards are funded and managed by the parent/guardian’s wallet account.)

  • Bill Payments: Pay utility bills and mobile airtime directly from your wallet through integrated billers.

  • Peer-to-Peer Transfers: Send and receive money instantly to/from other WinExpress users (peer transfers).

  • Merchant Services: Vendors and small businesses can join as WinExpress merchants. Participating merchants are equipped with Moniepoint POS devices. (Moniepoint MFB Limited is a CBN-licensed microfinance bankmoniepoint.com that powers most POS transactions in Nigeria.) Vendor wallets and business accounts are created with Moniepoint as the underlying bank.

All services are provided under these Terms and any additional policies posted on our site. You must use WinExpress lawfully – you must not use the service for illegal activities or to infringe anyone’s rights. We reserve the right to refuse service or suspend accounts used in breach of any applicable law or regulation.

3. Fees and Charges

WinExpress charges transparent fees as follows:

  • Transaction Fee: We deduct 1% of the transaction amount, capped at ₦200 per transaction. (For example, transferring ₦30,000 or more costs ₦200.) This flat-rate model aligns with industry practice for capped transaction fees.

  • Platform Fee: A quarterly maintenance fee of ₦500 is charged to active accounts.

  • Regulatory Charges: Any charges mandated by the CBN or card networks (e.g. card issuance or switching fees) will be passed on to users, as required by law.

Fees will be debited from your wallet balance. See our published Schedule of Fees (on our website) for details. All fee structures and caps will be clearly disclosed; WinExpress may update fees from time to time with notice.

4. Moniepoint POS for Merchants

WinExpress partners with Moniepoint MFB to empower merchants. Eligible vendor accounts opened through WinExpress are automatically set up with a Moniepoint POS terminal. Moniepoint MFB is fully licensed by the CBN, and its network processes the merchant transactions. As a merchant, you agree that your transactions will be processed through Moniepoint’s platform, and applicable Moniepoint terms and fees will apply. Any issues with the POS terminal or merchant settlement should be directed to WinExpress support, who will coordinate with Moniepoint.

5. Card Issuance and Use

  • WinEx Card (General): A physical WinExpress card is issued to each verified general user. This card is linked to your WinEx wallet and can be used at any merchant accepting Visa/Mastercard (or Verve) in Nigeria. Usage of the card is subject to all terms of the card network and regulatory guidelines.

  • WinEx School Card: The WinExpress School program provides physical cards for students, but those cards are funded by the parent’s WinEx School wallet. Parents/guardians (who are legal account holders) have full control over loading funds, setting spending limits, and viewing transactions on the child’s card. The child card carries the student’s name, but the parent’s account signs all agreements and is responsible for the card’s use.

All card usage is subject to CBN and Payment Scheme rules. You may incur additional charges (e.g., ATM withdrawal fees, inactivity fees) imposed by regulators or card networks. WinExpress is not responsible for any fees charged by ATM operators or local regulatory levies beyond the fees we publish.

6. User Responsibilities and Conduct

As a WinExpress user (individual or business), you agree to:

  • Use Responsibly: Do not misuse the Services. You must not use WinExpress for any illegal, fraudulent or unauthorized purpose.

  • Secure Your Account: Keep your login information, PIN, and devices secure. You are solely responsible for all activity on your account. Notify us immediately of any unauthorized access.

  • Accurate Information: Maintain accurate personal and contact information. Fraudulent or incorrect data may lead to account suspension or legal action.

  • Compliance: Comply with all applicable laws. We cooperate with law enforcement and regulators as required. If we suspect illegal use (e.g. money laundering), we may freeze or close your account without notice to comply with AML/CFT rules.

  • Age Restrictions: Ensure that minors in your care use the School card appropriately. Minors are prohibited from opening accounts on the general platform.

Failure to comply may result in account restrictions or termination.

7. Privacy and Data Protection

We respect your privacy. All personal data collected from you will be processed in accordance with applicable laws. Specifically, WinExpress will handle your data in compliance with the Nigeria Data Protection Regulation. We only collect and share data necessary for regulatory compliance (e.g. KYC) and service provision. Our Privacy Policy (available on our site) describes how data is collected, used, and protected.

8. Liability and Disclaimer

WinExpress services are provided “as is”. To the fullest extent permitted by law, WinExpress and its partners disclaim all warranties and are not liable for any indirect, incidental, special or consequential damages arising from the use of our services. In particular, we are not responsible for:

  • Third-Party Services: We are not liable for the quality or availability of third-party utility providers, merchants, or POS networks.

  • Transaction Errors: Except as required by law, we are not responsible for errors caused by you (e.g. sending funds to the wrong account) or by third parties.

  • Regulatory Actions: We comply with CBN/NDIC directives; we are not liable for any service disruption due to legal or regulatory actions.

Your sole remedy for any dissatisfaction is to discontinue use of the service.

9. Amendments and Governing Law

WinExpress may modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website or app. Your continued use of WinExpress after changes implies acceptance of the new Terms.

These Terms are governed by Nigerian law. Any disputes will be subject to the exclusive jurisdiction of the Nigerian courts or an agreed dispute resolution mechanism.
